City of Port Washington Impact Fee Program Analysis

In October of 2020, Staff recommended an analysis of the City’s Impact Fee Program, which had been in existence since 1999. Over the next nine (9) months, the Program was analyzed, conclusions were arrived at, and Staff planned for recommendations to the Common Council.

Overall, the comprehensive review concluded the following principal findings:

  1. From 1999 through 2020, $3,952,780 in impact fees were collected from 820 properties.
  2. Currently, the City has approximately $2,014,315 in four (4) impact fee reserve accounts.
  3. The total impact fees that should have been collected for the four (4) projects under the existing ordinance is $2,854,803, resulting in an excess collection of $1,097,977.
  4. Due to errors in how impact fees were calculated, $1,176,898 (Note: dollar figure includes interest) in refunds is owed to approximately 105 payers of the fee.
  5. In accordance with State statute, due to the fee calculation errors refunds are due to the payer of the fees for the affected properties, with interest.
  6. In accordance with State statute, due to the excess funds collected refunds are due to the payer of the fee for the affected properties, with interest.
  7. The balance in the impact fee reserve accounts is more than sufficient to pay all the refund due. There will be no monetary impact to the City’s general fund, taxpayers, or property tax levy.

These findings were presented to the Common Council on August 17,2021. At the same meeting, the Council unanimously passed the following motion:

"I move that: (1) Staff refund payers of impact fees who overpaid and/or who paid in excess of the costs attributable to growth, with interest, as described in the Impact Fee Analysis Final Report; (2) and appropriate approximately $1.2M from the necessary funds to complete the refunds."

In turn, City Staff will undertake the task of refunding all the identified individuals/businesses who are eligible for one.

NOTE: One year after the initial date of the Impact Fee Refund Program, any unclaimed funds will be sent to the Office of the Ozaukee County Clerk.
